1. Who we are
The Service is operated by CompuSage, LLC, 1301 Brookside Coalburg Road, Mount Olive, AL 35117, United States ("we", "us", "our"). You can contact us at buzz@internationalmathbee.org.
2. Accepting these Terms
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.
3. Who can use the Service
- Account holders must be adults. You must be at least 18 years old to create a Parent/Teacher account and to buy seats. A credit or debit card payment is used to verify that the account holder is able to contract.
- Students play under your account. The game is designed for students in grades 1 to 6. A student may use the Service only through a student account created by their parent or guardian, or by a teacher acting for their school. Children may not create their own accounts.
- You are responsible for the students on your account and for how they use the Service.
4. Your account
- You agree to give accurate and current information and to keep it up to date.
- You are responsible for keeping your password and your students' passwords safe, and for activity under your account. Tell us at once if you believe your account has been used without your permission.
- Each student plays under an anonymous username, which the public cannot use to identify the student. Usernames must not be offensive and must not impersonate another person. A student's anonymous username cannot include three or more consecutive letters from the student's first or last name.
5. Student accounts
- By creating a student account, you confirm that you are the student's parent or legal guardian, or a teacher or school official authorized to register that student.
- You consent to our collection and use of the student's Personally Identifiable Information (PII) as described in our Privacy Policy.
- A student can be transferred from one Parent/Teacher account to another, for example when a student changes school. The student keeps their account and batting average.
6. Teachers and schools
If you register students as a teacher or on behalf of a school or district, you confirm that your school or district has authorized you to do so, and that it has given any notice to parents, or obtained any consent, that the law or school policy requires. CompuSage, LLC controls and protects the PII held in the Service, and no PII about a student is ever made public. We use student PII only to provide the Service for the school's educational purposes, and we will delete it when the school asks. On request, we will complete a district's vendor review and sign a student data privacy agreement.
7. Seats and subscriptions
- Free account. The Parent/Teacher account is free. A student needs an assigned seat to play.
- Seats. One seat lets one student play at a time. You can unassign a seat and give it to another student.
- Price. Seats cost US$2.99 per seat per month or US$32.00 per seat per year. Prices are shown before you buy. Prices include any applicable taxes.
- No free trial. You are charged when you buy seats.
- Automatic renewal. Your billing period starts on the day you buy your seats. Your subscription renews automatically at the end of each monthly or yearly period, depending on the plan you chose, at the price then in effect, until you cancel.
- Cancelling. You can cancel at any time in the Subscriptions section of the Portal. The cancellation takes effect on the last day of your current billing period. Your seats stay active until then and will not renew for the following month or year.
- Refunds. Except where the law requires otherwise, payments are not refundable.
- Price changes. We may change prices. We will give you reasonable notice before a change applies to your next renewal, so that you can cancel if you wish.
8. Payments
Payments are processed by Stripe. You can pay by card, Apple Pay or Link. We do not see or store your full card number. Prices are set in U.S. dollars. Depending on your location, the amount may be shown and charged in your local currency at the exchange rate at the time. You confirm that you are authorized to use the payment method you provide. Each payment appears in Billing History with a downloadable invoice.
9. Rankings and leaderboards
Students are ranked by batting average against other students in the same grade at the State, National Math Bee® and International Math Bee® levels. Leaderboards show only anonymous usernames and batting averages, so the public cannot identify any student. Rankings are for motivation and fun. They carry no prize or cash value unless we announce a specific promotion with its own rules. We may correct or remove results that we reasonably believe were obtained unfairly.
10. Acceptable use
You agree not to, and not to allow students to:
- share one student account among several students;
- use automated tools, scripts or other unfair methods to play or to affect rankings;
- try to access other users' accounts or data, or interfere with the Service;
- copy, modify, resell or reverse engineer the Service;
- use the Service in any way that breaks the law.
11. Intellectual property
The Service, including the game, software, design, text and graphics, belongs to CompuSage, LLC and its licensors and is protected by copyright, trademark and other laws. International Math Bee®, National Math Bee® and BatterUp® are registered trademarks and may not be used without our written permission. We give you a limited, personal, non-transferable right to use the Service under these Terms.
12. Feedback
If you send us ideas or suggestions about the Service, you agree that we may use them freely, without payment or obligation to you.
13. Links to other websites
The Service may link to websites that we do not control. We are not responsible for their content or practices.
14. Ending or suspending accounts
You may stop using the Service at any time, and you can ask us to delete your account. We may suspend or close an account that breaks these Terms or puts the Service or other users at risk. Where reasonable, we will tell you first.
15. Disclaimer
The Service is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties, express or implied, including that the Service will be uninterrupted or free of errors, or that it will achieve any particular educational result. Some places do not allow certain warranties to be excluded, so some of this may not apply to you.
16. Limitation of liability
To the fullest extent the law allows, our total liability to you for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim, or US$100 if you have paid nothing. We are not liable for indirect, incidental, special or consequential damages. Nothing in these Terms limits liability that cannot be limited by law.
17. Governing law and disputes
These Terms are governed by the laws of the State of Alabama, United States, without regard to its conflict of law rules. If you have a concern, please contact us first at buzz@internationalmathbee.org so we can try to resolve it informally. If you are a consumer in the European Union or the United Kingdom, you also benefit from the mandatory consumer protection laws of the country where you live.
18. General
- If any part of these Terms is found to be unenforceable, the rest remains in effect.
- If we do not enforce a right, that is not a waiver of it.
- If these Terms are translated, the English version controls in case of a difference.
- You confirm that you are not barred from using the Service under United States export or sanctions laws.
19. Changes to these Terms
We may update these Terms. If a change is material, we will give at least 30 days' notice by email or in the Portal before it takes effect. If you continue to use the Service after the change, you accept the updated Terms.
